innFactory AI Consulting from Rosenheim advises companies in the DACH region on GDPR- and AI-Act-compliant use of AI. Suno is an AI music generator from Suno, Inc. (Cambridge, Massachusetts, USA) that turns text, lyrics, audio, images or video into complete songs with vocals. The current model generation is Suno v6 with v6, v6-wild and v6-mini, alongside Suno Studio 2.0, a browser-based music production environment. As of October 2026.

Suno is not a text AI and not a typical building block for enterprise chatbots. It matters to businesses mainly in two cases: for quick music prototyping (jingles, demos, mood boards) and because employees often use the service privately or on the side anyway. Both raise questions about usage rights, data protection and the legal situation, which we put into context here.

What is Suno?

According to its Terms of Service, Suno, Inc. is headquartered in the United States (contact address Suno Legal, 17 Dunster Street, Floor 4, Cambridge, MA 02138); the Terms are governed by Massachusetts law. On 3 June 2026 Suno announced a Series D round of over USD 400 million at a post-money valuation of USD 5.4 billion (led by Bond Capital). On its user base, Suno spoke in November 2025 of “nearly 100 million music makers”. All figures according to the Suno blog.

Suno v6, v6-wild and v6-mini

Suno describes v6 as “a new generation of music models” developed with industry partners such as Warner Music Group, BMG and Believe. According to Suno the models are faster, more expressive and higher quality than earlier versions; there are no reliable independent benchmarks. New capabilities per the announcement:

  • Edit parts of a song by plain-language instruction (“Change the chorus so it’s sung by a gospel choir”), update single lyric lines
  • Mashups from multiple sources, plus sampling, isolating and building a beat in one workflow
  • Inputs as text, audio, images or video
  • Orientation on mood, genre or references rather than single commands

v6-wild is meant as a deliberately less predictable variant for finding ideas, v6-mini as a fast variant for all users.

Suno Studio, stems and further features

Suno Studio 2.0 (13 August 2026, for Premier) adds MIDI import and recording, a wavetable synth, a chat bar (beta) for natural-language control, improved stem separation, audio effects and plugins, and automation. According to Suno, Premier subscribers can export multitracks and stems at 32-bit / 48 kHz without limits. Further features per the pricing page: Covers, Extend, Remix, audio upload (Free up to 8 minutes, Pro/Premier up to 30 minutes), Voices, Custom Models, Personas and advanced editing.

Prices per the pricing page, as of October 2026, see the provider. For monthly billing, the savings notes on the pricing page imply USD 10 (Pro) and USD 30 (Premier). Extra credits and downloads can be purchased; credits included in a subscription are not carried over according to the pricing page, while purchased top-up credits do not expire but require an active subscription. For Premier users of Suno Studio, Suno states there are no download limits. The pricing page lists no business plans with contract and SLA.

Rights and licences

Usage rights to output

Under the Terms of Service (version 10 August 2026, effective 3 September 2026):

  • Paid plans (Pro, Premier): Suno assigns its rights in the output to the user. Commercial use is permitted, but only for songs downloaded through a download channel provided by Suno. Recording or stream-ripping is prohibited.
  • Free plan and trial downloads: personal, non-commercial use only.
  • Remixes: remixes created through the remix feature are treated as a joint work and may only be used personally and non-commercially.
  • Watermarks: Suno may append fingerprints, watermarks and metadata; they must not be removed to conceal provenance or plan tier.
  • No copyright assurance: Suno expressly makes no representation that any copyright will vest in an output. Whether and when purely AI-generated music is protected by copyright depends on the jurisdiction and the degree of human creative contribution, and is not conclusively settled.

These rules are contractual arrangements with Suno and do not settle whether third-party rights (for example in melodies or lyrics) are affected. For use in advertising, sound branding or products we recommend a legal review in each case.

Download limits

Since 3 September 2026, Suno applies download limits: Free up to 7 trial downloads once, Pro 20 per month, Premier 60 per month; additional downloads can be purchased. The limits also apply to songs created earlier. All songs remain playable and shareable in the library. On 25 November 2025 Suno had already announced that downloads would require a paid account.

Licensed models and label partnerships

  • Warner Music Group: partnership of 25 November 2025; according to Suno, new models are to be built on high-quality licensed music, and WMG artists can opt in to make names, voices and compositions available for new experiences.
  • BMG: global partnership of 12 August 2026, part of the launch of the “first music model developed with the music industry”.
  • Believe and TuneCore: partnership of 8 September 2026; tracks from the new industry-partner model are to become eligible for distribution via Believe and TuneCore.
  • Suno has not published in detail which training data v6 uses or under which licence terms. Statements such as “v6 is trained exclusively on licensed data” could not be verified from Suno’s announcement.

Ongoing proceedings

  • GEMA v Suno (Regional Court of Munich): According to GEMA’s press release of 31 July 2026, the 42nd chamber found that Suno infringes US and German copyright law by training on GEMA works in the US and by storing and reproducing them in Europe, and that it needs a licence to use the GEMA repertoire. The case covered, among others, six well-known songs. The decision is a first-instance ruling; we have not evaluated the full text of the judgment.
  • Universal Music Group and Sony Music: According to press reports the US proceedings continue; no settlement has been reported. Check court records or current reports for the latest status.

For businesses this means the legal situation around training and output of AI music services is in flux. Anyone publishing Suno results externally bears the residual risk.

Key points from the Privacy Notice (last modified 23 June 2026):

  • Third-country transfer: Suno is based in the US and generally stores information on servers in the US; data of EEA/UK users is processed there. There is no evidence of EU hosting. The Privacy Notice does not state whether Suno is certified under the EU-US Data Privacy Framework; we could not verify this reliably and recommend checking the DPF register.
  • Training: According to the Privacy Notice, user activity, inputs and other content are also used to train and improve the models (legitimate interest).
  • Voice data: Voices processes voice recordings that may count as biometric data depending on the jurisdiction. Retention per the Notice up to three years after the last interaction.
  • EU/UK representative: VeraSafe (Art. 27 GDPR).
  • No enterprise agreements documented: We found no data processing agreement or enterprise commitments.

Practical consequence: no personal, confidential or brand-sensitive content in prompts and lyrics; no third-party voices for Voices (the Terms allow only your own voice).

Unofficial wrappers

Many open-source projects and third-party providers offer a “Suno API”. They are not operated by Suno, in part use the web interface, and may breach the Terms (prohibition of scraping and automated data extraction). We do not recommend them for business processes.

Model lifecycle

  • Suno v3 (21 March 2024): first model for radio-quality songs.
  • Suno v4 (19 November 2024): Remaster, ReMi lyrics assistant, cover art, upgrades to Covers and Personas.
  • Suno v4.5 (1 May 2025): more genres, richer vocals, combinable Personas, Covers and Extend.
  • Suno v5 (2025): predecessor of v5.5.
  • Suno v5.5 (26 March 2026): Voices, Custom Models, My Taste.
  • Suno v6 (9 September 2026): v6, v6-wild, v6-mini.

According to Suno, all earlier models are being retired with the v6 rollout; songs already created remain playable and shareable and can still serve as the basis for covers and remixes. If you need to reproduce projects made with older models, secure the results.

Integration with CompanyGPT

Suno is a music service, not a text AI. It is therefore not part of the model selection in CompanyGPT. A connection would only make sense through official interfaces, and we have not found a publicly documented Suno API. We advise against connecting via unofficial wrappers.

CompanyGPT is useful in the surrounding workflow, though: texts, lyric drafts and briefings can be developed in a GDPR-compliant way in CompanyGPT before being transferred to a music tool. The innFactory AI Gateway controls costs and access for AI services in your own tenant. For audio providers with an API, alternatives such as ElevenLabs (Music) or Stable Audio are worth considering.

Our recommendation

For prototyping and internal content: Suno v6 or v6-mini are suitable for quickly creating music ideas, demos and background music for internal videos. Commercial use requires a paid plan and download through the Suno channel.

For advertising, brands and products: We recommend checking the chain of rights in advance: no assurance on copyright in output, ongoing proceedings (including GEMA, UMG, Sony) and no documented training data basis for v6. Alternatively, ElevenLabs Music (according to the vendor trained on licensed data, with API and Enterprise tier) or Stable Audio offer documented routes; a case-by-case review is still needed there.

Data protection: No personal or confidential content in prompts, no Voices of other people. An internal policy for the use of AI music services and the labelling of AI audio creates clarity. Contact us for advice.

Frequently Asked Questions

What is Suno?

Suno is an AI service from Suno, Inc. (USA, Cambridge, Massachusetts) that turns text descriptions, lyrics, audio, images or video into complete songs with vocals and instrumentation. The current model generation is Suno v6 (announced 9 September 2026) with three models: v6, v6-wild and v6-mini. The platform also includes Suno Studio 2.0 (a browser-based DAW), stem separation, covers, Voices and custom models. Suno is a music service, not a text AI.

Which Suno version is current?

The current version is Suno v6, announced on 9 September 2026. v6 is the flagship for Pro and Premier plans, v6-wild is the experimental variant for those plans, and v6-mini is the faster variant available to all users including Free. According to Suno, all earlier models (including v5.5 of 26 March 2026, v4.5 of 1 May 2025, v4 of 19 November 2024 and v3 of 21 March 2024) are being retired as v6 rolls out; songs already created stay in the library.

Is Suno free?

There is a Free plan with 50 credits per day and access to v6-mini, but without monthly song downloads and without commercial rights. Paid plans are Pro (USD 8 per month billed annually, 2,500 credits, 20 downloads per month) and Premier (USD 24 per month billed annually, 10,000 credits, 60 downloads per month, Suno Studio). Prices per the pricing page, as of October 2026, see the provider.

Can Suno music be used commercially?

Under Suno's Terms of Service (version of 10 August 2026, effective 3 September 2026), only for songs you downloaded as a paying Pro or Premier user through a permitted download channel. Free-plan songs and trial downloads are limited to personal, non-commercial use. Suno also gives no assurance that copyright subsists in AI-generated songs, and watermarks and fingerprints must not be removed. For advertising and brands we recommend a legal review in each case.

Is Suno GDPR compliant?

That cannot be answered with a blanket yes. According to the Privacy Notice (last modified 23 June 2026), Suno generally stores data on servers in the United States, also uses inputs, content and chats to train and improve its models, and processes voice data for its Voices feature that may count as biometric data depending on the jurisdiction. VeraSafe is named as EU/UK representative under Art. 27 GDPR. We found no statement on EU hosting or on EU-US Data Privacy Framework certification in the Privacy Notice. Personal or confidential data does not belong in prompts.

Does Suno have an API?

Suno runs a page called Suno Platform at platform.suno.com that announces a REST API for songs, covers and mashups. Public documentation, pricing and API terms are not visible there without signing in, so we cannot verify the scope. Unofficial Suno API wrappers and third-party providers are not operated by Suno, in part access the web interface, and are a compliance risk; Suno's Terms prohibit scraping and automated data extraction.

What is the legal situation between Suno and GEMA?

GEMA filed a lawsuit against Suno at the Regional Court of Munich on 21 January 2025. According to GEMA’s press release of 31 July 2026, the court’s 42nd chamber found that Suno infringes US and German copyright law by training on works from the GEMA repertoire in the US and by storing and reproducing them in Europe, and that it is subject to a licensing obligation. The case covered, among others, six well-known songs such as “Atemlos” and “Daddy Cool”. The decision is a first-instance ruling; we have not evaluated the full text of the judgment. Separately, Suno has announced partnerships with Warner Music Group (25 November 2025), BMG (12 August 2026) and Believe/TuneCore (8 September 2026).

Are there alternatives to Suno for businesses?

Depending on requirements, businesses can look at ElevenLabs Music (according to the vendor trained exclusively on licensed data, with an API and an Enterprise tier with EU data residency) and Stable Audio from Stability AI. We cover both on separate pages. Which option fits depends on chain of rights, API needs, data residency and audio quality; we do not give a binding ranking.
